These Terms of Service ("Terms") govern your access to and use of LeadsCalc's website, embeddable calculators, APIs, and related services ("Services"). By using the Services, you agree to these Terms.

The Services

LeadsCalc provides software that lets you configure and embed interactive calculators, capture leads, generate reports, and connect to integrations you configure (such as webhooks). Features may vary by plan.

Accounts

You are responsible for safeguarding your account credentials and for all activity under your account. You must provide accurate information and keep it up to date.

Customer obligations

• You will comply with applicable laws (including marketing, privacy, and anti-spam laws) when collecting data from your visitors.
• You are responsible for your embed configuration, branding, messaging, and any destination systems (e.g. CRMs, webhooks).
• You will not use the Services to distribute malware, harass others, or violate third-party rights.

Plans and billing

Paid plans, when offered, are billed according to the checkout flow you accept at purchase. Unless stated otherwise, fees are non-refundable. We may change pricing with reasonable notice where required.

Acceptable use

You may not probe, scan, or test the vulnerability of our systems without permission; circumvent rate limits or security controls; or use the Services in a way that could damage, disable, or impair them.

Intellectual property

LeadsCalc retains all rights in the Services. You retain rights in your own content and visitor data, subject to the rights we need to operate the Services (for example, to host configuration and deliver reports).

Disclaimer

THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. CALCULATOR OUTPUTS ARE ESTIMATES AND NOT PROFESSIONAL, FINANCIAL, OR LEGAL ADVICE.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LEADSCALC AND ITS SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICES IN THE THREE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (USD $100), IF YOU HAVE NOT PAID US.

Suspension and termination

We may suspend or terminate access if you materially breach these Terms, create risk or legal exposure, or if we discontinue the Services. You may stop using the Services at any time.

Changes

We may modify these Terms. If a change is material, we will provide notice as appropriate (for example, by posting an update or emailing the address on your account). Continued use after the effective date may constitute acceptance.
